Terms of Service

These Terms of Service (“Terms”) govern your access to www.heliosrealestatemedia.com and your purchase or use of services provided by Helios Real Estate Media (“Helios,” “we,” “our,” or “us”).
By accessing our website, booking a service, accepting an estimate, submitting payment, or using delivered media, you agree to these Terms and any project-specific estimate, invoice, order form, or written agreement.
If you book services on behalf of a brokerage, company, property owner, or another organization, you represent that you have authority to accept these Terms on its behalf.
1. Services
Helios provides professional real estate media and marketing services, which may include:
- Interior and exterior real estate photography
- Aerial and drone photography
- Cinematic property films
- Vertical video and social-media content
- Agent branding and promotional content
- Floor plans and property measurements
- Virtual tours and interactive media
- Custom property websites
- Twilight photography and virtual twilight editing
- Image enhancement, object removal, and specialty editing
- Media hosting, delivery, and related marketing materials
The exact scope, price, deliverables, and estimated delivery schedule for a project will be described during booking or in an applicable estimate, invoice, order confirmation, or written agreement.
2. Booking and Authorization
A booking is not guaranteed until it has been accepted or confirmed by Helios.
By booking a project, the client represents that the client:
- Is authorized to request services at the property
- Has obtained any required permission from the property owner or occupant
- May provide property access information to Helios
- Has authority to approve the requested media and marketing work
- Will provide accurate project, property, and contact information
We may decline, postpone, or cancel a project when necessary because of safety concerns, access limitations, legal restrictions, nonpayment, weather, scheduling conflicts, inappropriate conduct, or circumstances beyond our reasonable control.
3. Pricing and Payment
Pricing is based on the services, property size, location, complexity, travel requirements, turnaround time, and selected add-ons.
Unless otherwise stated in writing:
- Prices are subject to change before a booking is confirmed
- Additional services or requests may result in additional charges
- Applicable taxes, travel fees, rush fees, or platform fees may be added
- Payment is due according to the invoice or booking terms
- Delivered media may not be used until all required payments have been made
We may withhold delivery, downloads, licensing rights, or future services while an account remains unpaid.
The client is responsible for reasonable costs incurred in collecting overdue balances to the extent permitted by law.
4. Cancellations and Rescheduling
Clients should provide at least 24 hours' notice when canceling or rescheduling an appointment.
A cancellation, rescheduling, travel, or lockout fee may apply when:
- Insufficient notice is provided
- The photographer or media professional has begun traveling
- The photographer or media professional has arrived at the property
- The property cannot be accessed at the scheduled time
- The property is not ready and the appointment cannot reasonably proceed
- An occupant, animal, contractor, or unsafe condition prevents completion
Weather-dependent services may be rescheduled when Helios determines that conditions are unsafe, legally restricted, or unlikely to produce professional-quality results.
Cloud cover, seasonal landscaping, ordinary wind, neighborhood activity, or a client's preference for different weather may not automatically qualify for a complimentary reshoot.
5. Property Readiness
The client is responsible for ensuring that the property is clean, staged, accessible, safe, and ready before the scheduled appointment.
Unless specifically included in the booked service, Helios is not responsible for:
- Cleaning or decluttering the property
- Moving furniture or heavy objects
- Making beds or arranging personal belongings
- Completing repairs or landscaping
- Hiding valuables, medications, documents, or personal information
- Supervising children, occupants, pets, vendors, or contractors
- Removing vehicles, trash containers, hoses, seasonal items, or signage
Our team may make minor adjustments to small items when practical, but is not required to stage or prepare the property.
Helios is not responsible for media reflecting the property's actual condition at the time of the appointment.
6. Property Access and Safety
The client must provide lawful, timely, and safe access to all requested areas.
The client must disclose known hazards, including:
- Aggressive or unsecured animals
- Unsafe stairs, decks, floors, or structures
- Construction activity or exposed materials
- Environmental hazards or dangerous substances
- Alarm systems or access limitations
- Occupants who have not consented to entry
- Restricted, private, or prohibited areas
Helios may refuse to enter or photograph an area that appears unsafe, unlawful, inaccessible, or outside the agreed project scope.
7. Occupants, Pets, and Personal Property
The client is responsible for coordinating with property owners, tenants, guests, children, contractors, and other occupants before the appointment.
Pets should be safely secured unless their inclusion has been approved in advance. Helios is not responsible for escaped animals, animal behavior, or delays caused by unsecured pets.
Clients should remove or conceal valuables, confidential records, identifying documents, family photographs, access codes, medications, and other sensitive items before the appointment.
8. Drone Services
Drone operations are subject to pilot judgment, aircraft capabilities, weather, property conditions, airspace restrictions, temporary flight restrictions, FAA requirements, and other applicable laws.
Drone services may be limited, postponed, modified, or canceled because of:
- Unsafe wind, precipitation, visibility, or temperature
- Controlled, prohibited, or restricted airspace
- Temporary flight restrictions
- Nearby airports, emergency activity, aircraft, or public events
- People, vehicles, animals, trees, utility lines, or structural obstacles
- Launch, landing, signal, or operational limitations
- Any condition the pilot determines creates an unacceptable safety risk
The remote pilot has final authority over whether and how a drone operation will be performed.
9. Floor Plans and Measurements
Floor plans, room labels, dimensions, calculated areas, and property measurements are provided for general marketing and illustrative purposes only.
They are not intended to serve as:
- Architectural drawings
- Engineering plans
- Appraisals
- Surveys
- Building-code certifications
- Legal descriptions
- Guaranteed statements of square footage
Measurements may vary because of equipment, access, wall thickness, rounding, property configuration, or measurement methodology. Clients should independently verify information that is material to a transaction.
10. Creative Direction and Editing
The client acknowledges that photography, filmmaking, editing, composition, lighting, music selection, pacing, color treatment, and other creative decisions involve professional judgment and artistic interpretation.
Helios will make reasonable efforts to follow written project instructions provided before production. However, booking our services does not guarantee a specific image count, camera angle, weather condition, composition, editing style, or creative result unless expressly agreed in writing.
11. Revisions and Reshoots
Requests concerning missing deliverables, technical defects, or material errors should be submitted promptly after delivery.
Complimentary revisions or reshoots may be provided when Helios determines that delivered work contains a material technical error attributable to us.
Additional charges may apply to requests resulting from:
- Changes in client preference or creative direction
- Instructions received after the appointment
- Property changes made after the original appointment
- Staging, cleaning, landscaping, construction, or repair issues
- Weather or seasonal conditions
- Objects, vehicles, occupants, animals, or contractors at the property
- Requests outside the originally purchased scope
- Extensive retouching or virtual alterations
Requests to materially alter a property's appearance may be declined when they could be misleading, unlawful, inconsistent with platform rules, or outside our professional standards.
12. Delivery and Hosting
Delivery dates and turnaround times are estimates unless expressly guaranteed in writing.
Delivery may be affected by:
- Project size and complexity
- Editing requirements
- Weather or rescheduling
- Client delays or incomplete information
- Payment status
- Third-party platform outages
- Technical problems or circumstances outside our reasonable control
Media may be delivered through a gallery, download page, cloud-storage platform, property website, embedded video player, or third-party service.
Unless a longer hosting period is promised in writing, clients should download and safely archive all final deliverables promptly. We do not guarantee permanent storage or indefinite availability of project files, galleries, links, or property websites.
13. Copyright and Ownership
Unless otherwise agreed in a signed written agreement, Helios retains all copyrights and ownership rights in photographs, videos, drone imagery, edits, graphics, designs, websites, and other original creative works produced by Helios.
Payment for services does not transfer copyright or ownership of the underlying work. Instead, the client receives a limited license as described below.
14. Client Media License
After all required payments have been received, Helios grants the purchasing client a limited, nonexclusive, nontransferable license to use the final delivered media for:
- Marketing the property associated with the original project
- Posting the property through an applicable Multiple Listing Service
- Publishing the listing on real estate portals and brokerage websites
- Promoting the listing through the client's professional social-media channels
- Including the listing in the client's professional portfolio
- Direct marketing reasonably related to the original listing
The license applies only to final delivered media. Unedited files, raw footage, source files, project files, and rejected images are not included unless expressly purchased or provided in writing.
15. License Restrictions
Unless Helios gives prior written permission, the client may not:
- Sell, sublicense, or transfer the media to another party
- Give the media to another agent for a new or competing listing
- Allow a builder, architect, designer, vendor, or publication to use the media commercially
- Use the media to market a different property, business, development, or product
- Submit the media to stock libraries or resale platforms
- Claim authorship or copyright ownership
- Remove copyright notices or embedded ownership information
- Use unlicensed music, footage, graphics, or other project components separately
- Use the media in a misleading, defamatory, unlawful, or unauthorized manner
Third parties seeking to use the media should contact Helios to obtain an appropriate license.
16. Property Websites and Digital Products
Property websites and related digital products may depend on third-party hosting, domain, mapping, video, analytics, or media-delivery services.
Unless otherwise stated, property websites are licensed for marketing the original property and may be disabled after the listing ends, the hosting period expires, the account becomes delinquent, or the applicable service is discontinued.
Domain names, hosting, integrations, and premium platform features may be subject to separate fees and third-party terms.
17. Portfolio and Promotional Use
Unless the client and Helios agree otherwise in writing before production, Helios may display completed work for legitimate business and promotional purposes, including:
- Our website and portfolio
- Social-media channels
- Digital and printed advertising
- Sales presentations and sample galleries
- Industry publications, competitions, and awards
- Educational or behind-the-scenes content
Clients handling confidential, private, off-market, occupied, or security-sensitive properties must notify Helios in writing before the appointment.
18. Client-Provided Materials
The client may provide logos, photographs, videos, music, scripts, trademarks, listing information, testimonials, or other materials for use in a project.
The client represents that the client has all rights and permissions necessary for Helios to use those materials as instructed.
The client is responsible for claims arising from materials, directions, statements, or information supplied by the client.
19. Music, Fonts, Stock Assets, and Third-Party Content
Some deliverables may contain licensed music, fonts, graphics, templates, video clips, or other third-party materials.
Those materials remain subject to their original licenses and may have restrictions concerning paid advertising, television, broadcast, resale, modification, transfer, or reuse outside the delivered project.
The client may not extract or separately reuse third-party components unless the applicable license expressly allows it.
20. Accuracy of Listing Information
The client is responsible for reviewing and approving property addresses, prices, descriptions, dimensions, spelling, agent information, brokerage information, links, and other factual content.
Helios does not independently verify listing representations and is not responsible for errors in information supplied or approved by the client.
21. Website Use
You agree not to:
- Use our website for an unlawful or fraudulent purpose
- Attempt to gain unauthorized access to accounts, servers, or systems
- Interfere with website operation or security
- Upload malicious code or harmful material
- Scrape, copy, reproduce, or exploit website content without permission
- Impersonate another person or misrepresent your authority
- Use automated systems in a manner that burdens or damages the website
22. Third-Party Platforms
Our services may interact with third-party platforms such as video hosts, cloud-storage providers, scheduling services, payment processors, mapping providers, social networks, real estate portals, and Multiple Listing Services.
Helios does not control and is not responsible for third-party platform rules, outages, compression, account restrictions, content removal, formatting changes, security practices, or discontinued services.
23. Disclaimer of Warranties
To the fullest extent permitted by law, our website and services are provided on an “as is” and “as available” basis.
Except for obligations expressly stated in a written agreement, Helios disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted availability.
We do not guarantee that media will result in a sale, increased listing traffic, a particular selling price, social-media engagement, or any other business result.
24. Limitation of Liability
To the fullest extent permitted by law, Helios will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunities, lost data, listing delays, reputational harm, or business interruption.
To the fullest extent permitted by law, Helios's total liability arising from a specific project or claim will not exceed the amount actually paid to Helios for the specific service giving rise to that claim.
These limitations do not apply to liability that cannot lawfully be excluded or limited.
25. Indemnification
To the fullest extent permitted by law, the client agrees to defend, indemnify, and hold harmless Helios and its owners, employees, contractors, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:
- The client's breach of these Terms
- Unauthorized or unlawful use of delivered media
- Inaccurate information or instructions supplied by the client
- Client-provided materials that infringe another party's rights
- Lack of authority to enter, photograph, film, or market a property
- Claims made by property owners, occupants, agents, vendors, or third parties
- Unsafe or undisclosed property conditions
26. Force Majeure
Helios will not be responsible for delays or failures caused by events outside our reasonable control, including:
- Severe weather or natural disasters
- Illness, injury, or emergencies
- Government actions or legal restrictions
- Utility, internet, hosting, or platform outages
- Equipment failure despite reasonable maintenance
- Transportation disruptions
- Labor disruptions
- Airspace restrictions or emergency flight activity
- Other events that could not reasonably have been prevented
27. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising from these Terms or our services must be brought in a court of competent jurisdiction located in Colorado.
28. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
29. Waiver
A failure by Helios to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
30. Entire Agreement
These Terms, together with the applicable booking confirmation, estimate, invoice, order form, licensing terms, and written project agreement, constitute the agreement between Helios and the client concerning the applicable services.
When a signed written agreement expressly conflicts with these Terms, the signed written agreement will control for that project.
31. Changes to These Terms
We may revise these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date.
Changes apply prospectively unless otherwise stated. Continued use of the website or booking of new services after an update constitutes acceptance of the revised Terms.
